The season's automatic, periodic Prime Evil damage proc (e.g. Diablo's Flames of Metus) is explicitly documented as scaling with weapon damage live - its reference tooltip numbers are shown for a specific level/paragon/item-power baseline and change as your gear does, meaning gearing up after choosing a Splinter continues to improve its damage with no re-snapshot needed.
This is a useful contrast case for players worried that switching Splinters or upgrading gear 'wastes' earlier progress: the reputation-gated upgrades and the base iconic power itself both read your live character stats each time they trigger.
The project's own splinter data explicitly labels the iconic power tooltip figures as 'reference values...scales with weapon damage,' consistent with a live (non-snapshot) damage source.
Example baseline: Splinter of Terror's Flames of Metus reads 20,720 direct + 165,758 DoT at Level 70/Paragon 200/Item Power 900, versus 8 + 66 at level 1 - a live scaling curve, not a fixed number.
Do not delay a weapon upgrade out of a mistaken belief that your Prime Evil power's damage is locked to when you unlocked it; it recalculates from your current gear on every trigger.
